South African law recognises electronic signatures in many commercial contexts under the Electronic Communications and Transactions Act 25 of 2002 (ECT Act), subject to exceptions (e.g. certain wills and deeds registry documents).

When is an electronic signature valid?

  • Standard electronic signature: data attached to or logically associated with the message, often sufficient for everyday contracts.
  • Advanced electronic signature (AES) may be required where identity and integrity are more critical—follow your bank, SARS, or regulator rules.
  • Some documents still need ink, notarial execution, or Deeds Office lodgement—your conveyancer or notary will advise.
